1. Service and operator
FitVoya is a fitness and nutrition diary with dated measurements, photos, charts, goals, food logs, step estimates, friend sharing and coach tools. It is not a healthcare provider, emergency service or medical device. The responsible legal operator and contact details still need to be supplied before these terms are finalized.
2. Accounts and young users
Use your own account, provide information you are entitled to provide and protect your sign-in details. Google sign-in is optional and subject to Google’s terms. FitVoya is intended for adults and teenagers, but an approved minimum age and age/guardian-verification process have not yet been established. Where local law requires a parent or guardian’s authorization, it must be obtained separately; a child’s click or these terms alone is not sufficient. Adult BMI categories and calorie-deficit estimates are not appropriate guidance for minors.
3. Estimates, exercise and safety
BMI, basal metabolic rate, calorie budgets, step counts, distance, calorie burn and goal progress are estimates based on user-entered information and formulas, not measured metabolism, diagnoses, prescriptions or guarantees of results. The browser step counter is still in development and unreliable. Read the separate health notice. Do not use the service to decide treatment, medication, extreme restriction or whether to ignore symptoms. Seek qualified help for age-appropriate exercise and nutrition; stop activity if unwell and contact local emergency services for an emergency.
4. Sharing and coaches
Friend requests require approval; friends see fields enabled in privacy settings. Approving a coach is different: an active coach can view all trainee fitness data, including photos, food, measurements, goals and activity, and may edit permitted fields. Trainees can log their own food, weight and lifts; goal editing may be restricted. Coach group views include trainee averages and filters. You can disconnect a coach in Settings. FitVoya provides tools, not a certification or endorsement of coaches; verify qualifications and agree separately on professional services and fees. Coaches must have a lawful basis to handle trainee data, obtain required guardian authorization, protect confidentiality and not reuse data for unrelated purposes.
5. Your content and permitted use
You retain rights in your journal, photos and plans. You permit processing and display only as needed to operate the service and the sharing you authorize; this does not grant a right to use your photos in advertising. Upload only content you own or have permission to use. Do not upload intimate or exploitative images, expose another person’s private data, harass users, misrepresent professional qualifications, access other accounts or attempt to defeat security. A downloaded before/after image shared outside FitVoya is outside its access controls; removing access cannot recall copies already saved by others.
6. Plans, AI and future charges
Coach tools are free for now; subscription billing and premium features are not currently connected. A future price, renewal interval, cancellation method, refund rules, taxes and applicable consumer rights must be disclosed before purchase and accepted where required. A free account or coach role is not authorization for a future charge. Planned AI food scans, trend insights and reports are not current services or promises of delivery. They require updated disclosures and any necessary separate consent before sending personal data to an AI provider; estimates will remain non-medical and require user checking.
7. Availability, reminders and account restrictions
Features can change, fail or be temporarily unavailable. In-app reminders may be delayed or missed and must not be relied on for medication or emergencies; lock-screen push delivery is not currently implemented. For abuse or security risks, access may be restricted as permitted by law, with notice and an opportunity to respond where appropriate. Paid-service changes and discontinuation, if introduced, remain subject to consumer law. Keep copies of information you need; no uninterrupted-service or permanent-storage guarantee is made.
8. Responsibility and mandatory rights
To the extent permitted by applicable law, no particular fitness result, estimate accuracy or uninterrupted availability is warranted. This does not exclude responsibility that cannot lawfully be excluded, including applicable consumer, privacy and bodily-injury rights or liability for fraud or intentional misconduct. Nothing transfers FitVoya’s own legal duties to users or waives statutory remedies. No arbitrary liability cap or blanket indemnity is imposed by this draft.
9. Changes, disputes and contact
Material changes should be clearly dated and notified before they apply; new purposes for sensitive data may require fresh consent, not merely continued use. Mandatory laws and competent courts remain applicable; no exclusive jurisdiction or governing-law choice is finalized without operator details and legal review. A functioning service/privacy contact must be published so users can raise disputes, rights requests and safety concerns. No contact address is invented here.
